League Liability Waiver: WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND GENERAL RELEASE AGREEMENT The ASK Kollel Activity: “Torah and Turf” In consideration of being allowed to voluntarily participate in any way in the above listed ASK Kollel Activity, Torah and Turf and its related events, I, the undersigned, acknowledge, understand, and agree that: 1. The risk of injury from the activities involved in the Torah and Turf events (also referred to as “Activities”) is significant, including but not limited to, the potential for permanent serious injury and/or death; and while particular rules, equipment, and personal discipline may reduce this risk, the risk of serious injury and death does exist; and 2. I knowingly and freely assume all such risks, both known and unknown, and assume full responsibility for my participation in the Activities; and 3. I willingly agree to comply with any and all stated instructions, policies, and customary terms and conditions for participation. If, however, I observe or experience any unusual significant hazard or danger during my presence or participation, it is my sole responsibility to immediately remove myself from any further participation the Activities; and 4. I understand, agree, and acknowledge that some Activities may be of a hazardous nature and/or include physical and/or strenuous activity. Understanding this, I state that: (a) to my knowledge, I have no medical condition or impairment that might inhibit my safe and active participation in the Activities; OR (b) I have a medical condition or impairment that might inhibit my safe and active participation in the Activities, and that I have knowingly and voluntarily chosen to, or failed to, disclose such condition(s) prior to participating in the Activities; and 5. I understand that traveling to and/or from such Torah and Turf events is not within the scope or course of the Activities, and thus, I am solely responsible for any damage or harm which may occur during the aforesaid travel; and 6. I understand that the ASK Kollel does not provide any medical insurance coverage for Activity participants, and that any applicable medical insurance must be provided individually by such participants; and 7. In the case of injury or medical emergency, and in the event participant, or their parent or guardian, cannot respond at the time of the emergency, I hereby authorize the ASK Kollel and its officers and agents to seek, administer, or have administered, whatever first aid or emergency medical care deemed necessary for my welfare, and it is understood that I, and not the ASK Kollel, shall be responsible for any and all charges for such health care services regardless of whether my medical insurance would cover such charges; and 8. I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release, indemnify, save, and hold the ASK Kollel, and its officers, directors, trustees, members, officials, agents, and/or employees, other Torah and Turf participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of any premises used to conduct the event or Activity (“Releasees”) harmless with respect to any and all injury, disability, death, or loss or damage to person or property, to the fullest extent permitted by law.
